HYDERABAD, April 13: The Sindh High Court circuit bench directed on Tuesday the SHO of the Satellite Town police station, Mirpurkhas, to lodge an FIR against Kandiari policemen if a cognizable case against them was made out by a complainant.

The order was passed on a constitutional petition filed by Umed Ali Farooque Ahmed, requesting the court to ask the SHO to lodge an FIR against policemen of the Kandiari police station.

Through Sindh Additional Advocate-General Masood A. Noorani, the SHO recorded before the court his statement in which he undertook to lodge an FIR by the complainant if a cognizable case was made out.

The petitioner said that some influential people had set an evil eye on the land of his brother and wanted to dispossess him of his property and that they had also instigated criminals against him.

He further said his nephew possessed around 285 acres of agricultural land in Deh Baao Khan in Sanghar, which were registered in the name of their late father, Mohammad Mureed. The land was divided among the deceased's sons and entries were made in record of rights.

The petitioner said that one of their relatives, in connivance with a land mafia and the local police, intended to deprive them of the land and had also issued threats to him.

He told the bench that land grabbers had attacked his house in Mirpurkhas, had trespassed on the house premises and had threatened him with murder if he did not vacate the land.

According to the petitioner, the land grabbers had the backing of the Sanghar DPO and the SHO of the Kandiari police station who, he said, would themselves get the land vacated and implicate him in false cases if he refused to leave it. He said he had immediately approached the Satellite Town police but they had refused to lodge his FIR.

He further said that since the matter involved jurisdiction of two districts, he had no other remedy available except that he should approach the court. He prayed to the court to direct the SHO of the Kandiari police station and the DPO of Sanghar to stop harassment of his family.

He also requested the court to ask the Satellite police SHO to take immediate action against the accused and register a case against them. The Satellite Town SHO said the petitioner had never come to police station and refuted the harassment allegation.
