KARACHI, Jan 26: An additional district and sessions judge (south) on Monday directed the superintendent of Karachi Central Prison to appear in person within three days and to explain as to why he did not comply with the court’s order regarding shifting of a gold trader to hospital.

The gold trader, Kamran Tessori, has been accused of possessing illicit weapon and a case was registered against him under the relevant sections of the Arms Ordinance at Gizri police station.

While allowing an application filed by the accused to get medical treatment, the court, on the previous hearing, directed the jail authorities to immediately shift the accused to the Aga Khan University Hospital and admit him if needed.

On Monday, the accused moved another application before Judge Nizar Ali Khawaja stating that the jail authorities did not shift him to the hospital despite the court’s order.

The judge came down hard on the jail authorities and asked the public prosecutor, Abdul Maroof, as to why his orders were not complied with.

The prosecutor submitted that the shifting of the accused to the hospital was delayed since the police squad was not available.

He sought some time for submitting the compliance report. However, the judge strictly directed the jail superintendent to personally appear in court within three days.

The Gizri police had arrested the gold trader at Karachi airport upon his arrival from Islamabad on Nov 5, 2008. Later he was remanded in judicial custody.

Some five criminal cases were registered against Mr Tessori in Karachi while a case was also registered against him in Badin.

Mumtaz Bhutto case

A judicial magistrate (south) issued a notice to a state counsel for Feb 2 on an application filed by the chief of the Sindh National Front, Mumtaz Bhutto, seeking exemption from personal appearance in court.

Mumtaz Bhutto and his party’s workers were booked in a case (FIR 01/09) relating to an alleged attack on the offices of a Sindhi language newspaper, Awami Awaz, under Sections 147, 148, 149, 506B, 452, 504 and 109 of the Pakistan Penal Code on the complaint of its Managing Editor, Dr Khair Mohamamd. The case was registered at Frere police station.

Show-cause notice

An additional district and sessions judge (central) issued a show-cause notice to the investigation officer of a 2002 road traffic accident case, which had claimed the lives of two college girls, for failing to appear in court despite repeated notices.

The judge had directed the investigation officer to appear in court on Monday but the latter did not appear.

According to the prosecution, Nida Afzaal and Rabia Beenish, the two intermediate students of APWA Collage Karimabad, were killed and many others injured on February 19, 2002 when the driver of route 5-C bus (JA 5983) while racing with another bus lost control.

The driver, Mohammad Munawwar, and the bus owner, M Ibrahim, were arrested after the incident. Sharifabad police registered a case (FIR 54/02) against them under Section 320, 322 and 337 of the Pakistan Penal Code. Later, they were released on bail.

Remand

A judicial magistrate (south) remanded a suspect in police custody till Jan 28.

The suspect, Irfan, said to be a close associate of an alleged gangster of Lyari, Arshad Papoo, was arrested by the Kalakot police in a robbery case.

The police said they recovered illegal weapons from his possession and registered a case under Section 13-D of the Arms Ordinance.
