ISLAMABAD, Jan 13: Former attorney general Malik Abdul Qayyum will defend the daughter of Chief Justice of Pakistan Abdul Hameed Dogar in the Islamabad High Court in the additional marks case.
When the IHC Chief Justice Sardar Muhammad Aslam took up the case against Ms Farah Dogar, Malik Qayyum along with Khalid Ranjah was present in the court to defend the CJ’s daughter.
The IHC chief justice asked the former attorney general that the relevant record of the Federal Board of Intermediate and Secondary Education (FBISE) was in the custody of the court and he could examine it if he desired.
The court put off the hearing in the petition of Muhammad Azam Khan Sultanpuri against the award of additional marks to Ms Dogar that enabled her to get admission in medical college, saying the petition would be taken up along with another identical petition filed by Iftikhar Hussain Rajpoot.
Talking to mediapersons outside court, the former attorney-general defended the award of additional marks to his client saying it was in accordance with the rules of the board.
Citing a ruling of the Supreme Court given in 2004 that there were laws of similar nature in the neighboring country.
Justice Qayyum said that if there was any violation of the rules, the proceedings should be initiated against the Federal Board not against his client. The board on the other hand had denied any wrongdoing in the award of additional marks.
The two petitions had been filed before the IHC praying to declare the marks awarded to the daughter of the CJ Abdul Hameed Dogar as unlawful and of no legal effect.
Separately the IHC adjourned the hearing in the appeals of PM
Prime Minister Yousaf Raza Gilani till January 15 after his lawyer sought the annulment of the conviction of the PM in two corruption references by an accountability court in 2004.
The PM had been seeking abolition of his sentence that was suspended by Lahore High Court Rawalpindi bench in 2006 and granted him bail. The two references were filed against him by NAB for inducting people in national assembly secretariat violating the merits and he was arrested in 2001.
