PESHAWAR, Oct 21: The Peshawar High Court on Tuesday disposed of a writ petition challenging the detention of six Nepalese including five juveniles under the Frontier Crimes Regulation (FCR) with the directives to the administration of Khyber Agency to conclude their trial within 10 days.

A two-member bench comprising Chief Justice Tariq Pervez Khan and Justice Ziauddin Khattak directed the petitioners that in case their trial could not be concluded in that period they should again move the high court.

The petitioners -- Tirthi Bahadur Gaurang and five juveniles Chandra Bahadur Tamang, Subah Bahadur Tamang, Prem Bahadur Tamang, Shyam Lal Tamang and Buddhiman Tamang -- were arrested by the authorities in Landi Kotal tehsil of Khyber Agency on June 11, 2008, when they were going to Afghanistan.

The petitioners, apparently cheated by a group of human traffickers, were shifted to Peshawar Central prison on July 7.

The petition was jointly filed for the six detained persons by Dost Welfare Foundation (DWF) and Voice of Prisoners (VOP) stating that the detained persons were having proper visa of Pakistan and had not violated any law.

Landi Kotal Assistant Political Agent Fazal Tawab appeared before the bench and stated that the petitioners were arrested for illegally entering Khyber Agency. He stated that they had been charged under section 11 and 40 of the FCR and section 14 of the Foreigners Act.

The APA stated that proceedings had already been started in their case and their trial would conclude in near future.

The court directed him to make it sure that the trial of the detained persons should conclude within 10 days.
