KARACHI: Petition dismissed

KARACHI, Aug 26: A division bench of the Sindh High Court comprising Justices Munib Ahmed Khan and Pir Ali Shah on Tuesday dismissed with costs a petition moved by M/s Mano Salva for reclaiming about two acres of land allotted to the company for setting up a poultry farm.

The petitioner said the land formed part of the 16 acres of land allotted to M/s Pakistan Refinery.

Advocate M. Ahmed Pirzada, special counsel for the provincial board of revenue, submitted that the petitioner had no valid claim to press.

The petitioner earlier instituted a suit in respect of the property but it was dismissed by a single judge.

An intra-court appeal was moved against the single judge’s order but it was withdrawn.

The appeal having been withdrawn, Advocate Pirzada said, the impugned judgment became final. The appellant could not be allowed to re-agitate the issue by a petition.

Hearing adjourned

Another petition filed by the residents of Deh Khadeji and Deh Abdar through Advocate Adnan Memon against allotment or sale of their land by the provincial government to the Defence Housing Authority was adjourned for hearing on Sept 2 to enable Advocate Anwar Mansoor Khan to appear in the case on behalf of the DHA.
