PESHAWAR, Aug 6: The Peshawar High Court on Wednesday deputed a bailiff for recovering a US nationality holder minor girl who was allegedly transported to Pakistan fraudulently by her father from the US.

A two-member bench comprising the Chief Justice Mohammad Raza Khan and Justice Yahya Zahid Gillani directed the bailiff to recover the two-and-a-half years old girl, Mayra Iman, within three days.

The bench fixed Aug 12 for next hearing of a habeas corpus petition filed by mother of the child, Ms Shaista Manzoor Tamana, seeking custody of her daughter and alleging that she had been kept in illegal confinement by her former husband, Rehan Yousaf, of Peshawar, and her former in-laws.

The court put on notice the respondents the girl’s father her paternal grandmother, Umme Salma, and her paternal aunt, Umme Farhat.

Advocate Nasrun Minallah appeared for the petitioner and contended that the girl only two-and-a-half years old and she should remain in custody of her mother. He contended that the girl was fraudulently moved to Pakistan and the petitioner had not been allowed to meet her.

Mr Minallah stated that earlier the petitioner had filed a petition before the district and sessions judge, which was dismissed on the ground that the respondents claimed that the girl was in Lahore and not in Peshawar. However, he added that as per their information the child had still been in Peshawar.—Bureau Report
