PESHAWAR, April 17: A petition of an Indian national seeking inheritance of his grandfather here has been admitted for full hearing by the Peshawar High Court.
A single bench, comprising Justice Malik Hamid Saeed, also issued notice to other parties. The court has to interpret section 83 of the Civil Procedure Code and to give ruling on the question whether an Indian national could file a suit without the permission of the Pakistan government.
Abdul Rauf Rohaila advocate appeared for the petitioner, Wajahat Hussain Shah, and argued that the provisions of section 83 of the Civil Procedure Code were not applicable to the instant case as the properties in dispute were owned by a person who was born and died in Pakistan and his legal heirs, including the plaintiff, had the right to get their respective share.
