KARACHI, Nov 18: The chief of the Mohajir Qaumi Movement (Haqiqi), Afaq Ahmed, through his counsel on Saturday submitted an application under Section-265-K of the Pakistan Penal Code (PPC) to the Additional District and Sessions Judge (Malir), Romana Siddiqui, pleading for acquittal in a fake murder case.

According to the prosecution, on July 30, 2002, Zubair Ali, son of Mashooq Ali, along with his mother Rafiqun Nisa was coming to their home in Nazimabad in a cab, when they heard gunshots fired in the area.

He along with his mother turned towards his sister’s house and when they reached Ammar Yasir Society near Lilly Town, three to four unknown persons allegedly opened fire at their taxi injuring his mother and the taxi driver, Kafiluddin.

The complainant took his mother to Al-Mustafa Trust, while Kafiluddin was rushed to the Jinnah Postgraduate Medical Center (JPMC) where he succumbed to his injuries.

The police had registered a case (FIR No144/02) under Sections 302, 324, 109/34 of the Pakistan Penal Code at Malir City police station against Mohajir Qaumi Movement (Haqiqi) chief Afaq Ahmed and others.

The defence counsel, Suhail Anjum submitted to the court that his client was innocent and had been falsely implicated in the case.

He said that there was no direct or indirect evidence on the record to implicate his client in the case, therefore there was no need for further probe into the case.

The court, which is conducting the trial in the central jail, adjourned the hearing of the case till Nov 19 and directed the public prosecutor, Jamal Nasir Baloch, for arguments on the next hearing.
