ISLAMABAD, Nov 10: Justice (retd) Wajihuddin Ahmed on Saturday moved an application in the Supreme Court requesting that the post-emergency judges should not hear his petition challenging the acceptance of nomination papers of Gen Pervez Musharraf by the Election Commission.

“Yes, we have filed the application in the Supreme Court,” the Advocate on Record of the petitioner told Dawn.

Wajihuddin Ahmed, who contested the presidential election against Gen Musharraf, said in the application that his petition should not be listed for hearing until Chief Justice of Pakistan Justice Iftikhar Mohammad Chaudhry and other judges of the Supreme Court resumed their duties and functions under the Constitution.

“The petitioner or his counsel shall not appear before PCO judges because they do not recognise them as judges,” the three-page application said, adding: “If any attempt is made by the PCO chief justice and judges to fix or dispose of this constitutional petition, they would do so at their risk and responsibility.”
