PESHAWAR, Oct 22: The Peshawar district and sessions judge, Miftauddin Khan, on Monday directed the capital city police officer to take departmental action against an SHO for threatening to imprison court bailiffs.

The court also issued a showcause notice to the SHO of Nasirbagh police station and summoned him on Oct 24.

The court issued the orders in a habeas corpus petition filed by Muhammad Siddique, a resident of Malkandher.

The petitioner had stated that the officials of Nasirbagh police station headed by the SHO raided his residence three days ago. He alleged that the police violated the sanctity of his home even though they did not have search warrants.

The petitioner said the police took away his two brothers — Akhter Shah (14 years old) and Muhammad Umer (19 years old) — and had been keeping them in illegal detention.

He stated that the detainees had not been produced before any court, which was illegal and unconstitutional.

The court directed two bailiffs, Sifatullah and Azmat, to raid the police station and recover the detainees.

When the bailiffs visited the police station they found out the two detainees imprisoned there without any charges. They stated that the police had not registered any FIR against them. The bailiffs said the SHO threatened them of dire consequences and told them that they should leave the police station otherwise they would be put behind bars. They added that the SHO also abused the petitioner.

They said the SHO threw away the court’s order and also ridiculed them by making some obnoxious comments. The court took exception to the attitude of the SHO and directed that he should appear in person and explain his position.
