ISLAMABAD, Oct 10: A four-member bench of the Supreme Court on Wednesday adjourned the hearing of an application filed by the nazim of the union council-33 of Peshawar.

The bench comprised Chief Justice Iftikhar Mohammad Chaudhry, Justice Sardar Mohammad Raza Khan, Justice Nawaz Abbasi and Justice Mian Shakirullah Jan heard the case.

The counsel for the UC nazim told the court that the no-confidence motion against the nazim had been unsuccessful because a two-third majority could not be mustered by the movers of the motion.

Justice Sardar Mohammad Raza Khan wondered how the nazim could remain in office when eight out of 11 members had voted against him.The counsel replied that under the local government rules, one more vote was needed to oust the nazim.

The minority member remained absent as he was also a member of the district council, he said.

The bench also questioned the legality of holding of two different offices, a question raised by the opponents of the union council nazim.

The chief justice adjourned the case for two weeks after observing that without hearing the respondents, the court could not proceed.

The same bench also adjourned the hearing of an application of Rasool Khan, assistant superintendent of the Postal Life Insurance of Kohat who challenged the judgment of

the Federal Service Tribunal. —APP
