ISLAMABAD, Aug 13: The Supreme Court on Monday ordered the Federal Board of Revenue (FBR, formerly Central Board of Revenue) to fix responsibility and award strict punishment for breaching its order of reinstating an officer.

A bench comprising Chief Justice Iftikhar Mohammad Chaudhry, Justice Javed Iqbal and Justice Faqir Mohammad Khokhar was hearing a contempt of court petition filed by Amin-i-Ajam, an income tax commissioner.

At the last hearing, the court had served contempt notices on FBR Chairman Abduallah Yousaf and Administration Member Malik Mohammad Yasin with a direction to appear on Monday for not implementing the decision to award minor penalty of censure instead of compulsory retirement to the petitioner. The FBR had to reinstate the income tax commissioner, who had been retired from services six years ago.

FBR Member Mumtaz Sheikh appeared before the court and submitted that the organisation had moved a review petition against the order of the apex court.

The chief justice observed that the organisation should have complied with the orders before filing the review petition.

He directed the official to conduct an inquiry, identify those responsible of not implementing the order and award stern punishment. “If you cannot do this then we will act accordingly,” he observed.

Advocate Tariq Mahmood, representing the petitioner, argued that officials junior to his client had been promoted.The chief justice directed the FBR to complete the process of giving promotion to the petitioner according to the rules and regulations and clear his dues within a week.

A report of the inquiry has to be submitted in two weeks to the Supreme Court registrar.
