HYDERABAD, Jan 11: A division bench of the Sindh High Court on Thursday ordered registration of an FIR against Tando Adam Police Station SHO Alan Abbasi for keeping a man in detention without any entry in the record.

The court accepted unconditional apology sought by Anti-Terrorism Court (ATC) judge Syed Ali Ashraf Shah although it considered his reply to a show-cause notice unsatisfactory.

The bench comprising Justice Mohammad Moosa K. Leghari and Justice Sajjad Ali Shah had issued a contempt of court notice to the judge for flouting an SHC order by remanding an accused, Abdul Qayyum, in judicial custody although he was to due be presented before the bench after he had been found in illegal detention during a raid by a court official, Ghulam Murtaza Shah.

Assistant Advocate-General Masood A. Noorani informed the court that the detained man had been charged as absconder in a kidnapping case by Bhittai Nagar police.

The court noted that the fact had been concealed by the applicant’s counsel.

It directed the applicant to seek remedy before a competent forum because he was facing trial in a kidnapping case.

The court directed the Sanghar district police officer to get an FIR registered against the Tando Adam SHO for keeping him in detention without an entry in the daily police station diary.

The SHO said an entry had been made in the Taluka police station while he had been kept at Tando Adam police station but the court didn’t give weight to his explanation.
