PESHAWAR, March 21: The Peshawar High Court on Tuesday decided to recount the votes cast during the elections of Lower Dir district nazim for ending the dispute between candidates. A bench comprising Chief Justice Tariq Pervez Khan and Justice Qaim Jan Khan fixed April 7 for recounting of the votes.
The court directed the Election Commission to present all the record of the polls.
The bench was hearing two writ petitions filed by candidates Mohammad Rasool and Ahmad Hassan Khan.
The returning officer had announced a tie between the candidates and decided to hold a toss of a coin in accordance with Rule 37 of the NWFP Local Government Elections, 2005. Both the petitioners had secured 98 votes each.
Both the candidates have challenged some votes and requested the court to declare them elected.
A dispute has also been going on in the high court over the officiating nazim of the district.
