ISLAMABAD, Dec 21: The Ministry of Law, Justice and Human Rights is preparing a draft, framing rules for government to facilitate the president to refer matters to the Supreme Judicial Council and make the Supreme Judicial Council effective.
A ministry’s spokesman said on Wednesday this was being done in pursuance of the Supreme Judicial Procedure of Inquiry Rules 2005 made by the Supreme Judicial Council on Nov 19 for effective implementation of Article 209 of the Constitution.
According to article 209(5) (a) and (b) if the president “is of the opinion that a judge of the Supreme Court or High Court is incapable of performing his duties due to any reason or is guilty of misconduct, the President shall direct the council to inquire into the matter”.
The ministry, he said, was preparing the draft on behalf of the information received by the president, alleging incapacity or misconduct of a judge. The draft would set out the procedure for entertaining, processing and directing matters to the Supreme Judicial Council by the President.
Once the Supreme Judicial Council received information, further proceedings would be taken according to the rules made by the SJC under Article 209 of the Constitution. — APP
