CBR SRO on confiscation of vehicles

Published November 19, 2005

ISLAMABAD, Nov 18: The Central Board of Revenue has decided to confiscate only those conveyances which are found carrying smuggled goods in false cavities or being used exclusively or wholly for transportation of smuggled goods.

The decision was taken through a customs notification issued here on Friday by amending SRO574 of 2005 to resolve the genuine problems of transporters regarding outright confiscation of conveyances.

It was decided that lawfully registered conveyances, which were not covered under the amended notification and were found carrying smuggled goods, might, however, be allowed to be redeemed against the minimum redemption fine of 30 per cent on customs value of the conveyance.

The CBR also clarified that in compliance with the order of the Lahore High Court, all collectors had been advised that all adjudicating officers might be directed to decide the cases in accordance with provisions of the law, notification prevailing at the time when the IGM was filed in respect of the offending goods.
