ISLAMABAD, Oct 4: The Supreme Court on Tuesday allowed senior vice-president of Pakistan Muslim League (PML) Mian Yasin Amjad Malik to contest the October 6 local government elections on the special peasant seat from Faisalabad district.

A three-member bench, comprising Chief Justice of Pakistan Iftikhar Mohammad Chaudhry, Justice M Javed Buttar and Justice Raja Fayyaz Ahmed, took exception to the intelligence report that Yasin Amjad Malik’s property details were bogus.

The court directed the Superintendent Police Special Branch Zafar Iqbal to take action against Inspector Gulzar for feeding a wrong information to his seniors about Mr Malik’s properties and ordered the Election Commission (EC) to include the petitioner’s name in the list of the candidates running for different offices in the final phase of the local government elections.

“Let the department take action against the inspector, otherwise it would be difficult for the SP if the court intervenes,” the chief justice observed.

According to the intelligence report, the petitioner owns property worth millions of rupees in Faisalabad in addition to 30 acres of agriculture land in Shorkot.

At the last hearing, the court had directed the district coordination officer, superintendent police Faisalabad and tehsildar and patwari of Shorkot to submit documents substantiating the ownership of 30 acres of the agriculture land by the petitioner.

On Tuesday, both the district returning officer (DRO) and Inspector Gulzar tendered an unconditional apology to the court for rejecting the papers and misreporting the property details of the petitioner.

Deputy Attorney General Nasir Saeed Sheikh also admitted that the intelligence report on the property of the candidate was incorrect.

The tehsildar also said that he had no property record of the petitioner. At this, the court directed the SP to take disciplinary action against the inspector. The court also said that it could ask about the outcome of the inquiry proceedings any time.
