KARACHI, Sept 27: The Sindh High Court on Tuesday dismissed a petition filed by a woman seeking quashment of a case against her husband and others in a Hudood case.
Ms Parveen submitted that she married Mohammad Nawaz against the will of her family and therefore her brother Arshad Ali lodged a case with Mirwah police station, Khairpur, against Mr Nawaz and Ghulam Hussain for kidnapping her and her sister Yasmeen.
The petitioner’s counsel sought quashment of the case as the petitioner is sui juris and married to Mr Nawaz with freewill.
He said story of Yasmeen’s missing was concocted as she was in custody of her own parents.
Additional Advocate-General Sarwar Khan submitted that the incident took place on July 6, while Nikah was performed on July 7, 2005 therefore it could not be said that abduction did not take place. Besides, the whereabouts of Yasmeen was to the day not known, he added.
He submitted that the investigation of the case could not be throttled at the moment.
SHC’s division bench comprising acting Chief Justice Ghulam Rabbani and Justice Azizullah M. Memon observed that it was well settled that investigation could not be throttled and needed to be completed.
DISPOSED OF: The Sindh High Court on Tuesday disposed of a petition filed by a retired steel mills employee against army officials after assurance by provincial and federal law officers that no harassment shall be caused as alleged by petitioner.
Abdul Ghani Khan alleged that Lt Waseem and Col Mir Mohammad Afzal were harassing him and his family members on directives of private persons Abu Saleh and Major (retd) Nazarul Islam with whom he had a monetary dispute.
They said respondents were raiding at his residence in Azizabad and threatening his family members, but SHO Azizabad was not registering case against them.
When the matter was taken up, Additional Advocate General Sarwar Khan and Standing counsel Mehmood Alam Rizvi stated that no harassment shall be caused as alleged by the petitioner. However, any action, if required, shall be taken in accordance with the law.
After assurance by petitioner’s counsel, Ashraf Hussain Rizvi did not press the petition. SHC’s division bench, comprising acting Chief Justice Ghulam Rabbani and Justice Azizullah M Memon, disposed of the plea as not pressed.—PPI/APP
