KARACHI, July 26: An anti-terrorism court has fixed Thursday for hearing arguments on a direct complaint against Shahnzaz Hamid, complainant in the murder case of her husband Shahid Hamid, for the offence of alleged perjury.

The complaint has been filed under Sections 476, 193, 194 and 195 of the Pakistan Penal Code by Nawab Mirza on behalf of Saulat Ali Khan, who was sentenced to death in the Shahid Hamid murder case by an anti-terrorism court on May 24, 1999.

The plea of the counsel for Saulat Khan is that Shahnaz Hamid made two different inconsistent and contradictory statements, one before the trial court and the other in form of an application to the SHO.

According to the counsel, the complainant woman at no stage gave the descriptions, particulars and identifications of the killers of her husband. He contended in the application that “she had concealed important piece of evidence from the ATC”.

Mr Mirza said that Saulat’s brother, Farhat Ali Khan, had filed a constitutional petition (No. 2344/2001) in the Sindh High Court praying to the court to declare that complainant Shahnaz Hamid had committed perjury by making contradictory statements.

However, the SHC dismissed the petition with the observation that the petitioner might file a direct complaint against the complainant for the offence of alleged perjury for redress of his grievance.

In that petition counsel Nawab Mirza contended that the perjury was committed by the complainant, therefore, a case might be registered against her.
