The International Cricket Council (ICC) on Wednesday ordered the Pakistan Cricket Board (PCB) to pay 60 per cent of the costs incurred by the Board of Control for Cricket in India (BCCI) and an ICC panel during the two boards' legal wrangle over a bilateral series agreement.

The ICC, whose Dispute Resolution Committee (DRC) had last month ruled in the BCCI's favour and dismissed the $70 million compensation claim against it, today delivered another blow to the PCB.

The global cricket governing body, in a press release today, announced that its DRC panel "has determined that the PCB should pay 60 per cent of the BCCI’s claimed costs as well as the administrative costs and expenses of the Panel" itself.

Furthermore, the ICC said that its judgement on the matter is "binding and non-appealable".

The PCB had filed the compensation case against India during former chairman Najam Sethi's era.

The board's stance in the case was that the Indian board had signed an MoU with Pakistan in 2014 in order to restore the bilateral series between the two countries which have remained suspended for the last 11 years. However the BCCI has refused to honour their commitment and have not implemented the conditions agreed in the MoU.

PCB officials were hopeful for a decision in their favour in the compensation case but the verdict announced on November 20 went against them.

Well, thats a news. Now pcb will think twice before going to icc for such cases. Dont know how much pcb will need to pay now but to me its an additional cost and totally wasted by pcb management. Use money wisely you will need them for future. Bcci has lot of money but they are also clever in handling cases.

What a fiasco. Instead of receiving compensation they have to now fork out the legal costs of both organizations!. Why was the ICC approached? Don't they know who rules the roost there? Going to an international arbitration panel would have been better.

Why insist on merely an MoU and then challenge on shaky ground in some kind of court with binding and unspeakable decisions? ever realized the world around you? Have it paid by Mr. Sethi who was behind all this costly expedition. Misplaced egos have cost this poor nation already enough. As for future cricketing with India, just write it off your books, for good. Also, either bring cricket back to its home grounds in Pakistan if you must keep playing, or just call cricket bye. Internal wrangling, players attitudes, misplaced priorities, mismanagement and financial losses make this one no different from Pakistan Steel, PIA, etc. Do at least some one thing right.

@Zak, The cost of fighting a case at ICJ is much higher than the penalty itself, besides if PCB looses in ICJ and is asked by ICJ to repay the expense and penalty at both ICC and ICJ than where will PCB go. Remember ICC is the boss and they know how to recover this penalty .

@Ahmed, Arbitration or law suits without ICC intervention will not be binding on either party. They can keep appealing ad nauseam with no end in sight - just spending money on legal consultants and lawyers. Even ICJ cases are not adhered to by countries all the time. So this was the best route one could take. Having said that a case based on emotion and hunch never pays off.

Everyone knows that Government has to give a ruling to play or NOT to play.. In this case, the Government of India refused and the only document that PCB could produce was an MOU, which is NEVER a legal document in any court.Kid on the street knows.

@Kashif, Just like PCB - you are responding on emotions. The case has nothing to do with money being paid by BCCI to win the case. It was a legal review of the case by 3 eminent judges part of DRC. DRC delivered the verdict and the compensation decision. Now saying that PCB wound not pay after having lost the case does not make any sense. When you know fully that the case can go either way. PCB’s argument was very tenuous especially when it was based on a MOU rather than a fully binding agreement.

The ruling was expected. As it was Mou (a non-legally binding document). And the MoU was signed in exchange of supporting big three revenue sharing model that we backtracked on, breaking Mou conditions. There was zero chance of winning this case from start, still PCB went ahead. Now have to bear the economic blunder because of mistake of few.

@ijaz, ICC conducts world tournaments. ICC makes money from such tournaments. ICC then disburses the profits to various cricket boards including PCB. What do you think ICC will do if you choose not to pay? PCB‘s press release says the following : “The PCB notes the ICC Dispute Panel’s decision on BCCI’s claims for their legal expense incurred on the PCB-BCCI dispute. The award of significantly lesser costs than claimed by BCCI reflects that PCB's case had merits. The PCB, however, reiterates its disappointment in the original decision/award given against it.“ PCB is mature enough to know that it has to pay.

Wow! India signed an MoU tp play bilateral series with Pakistan, refused to follow through on the agreement, and Pakistan is at fault. Not only ICC dishonored the MoU but is not asking Pakistan to pay BCCI and ICC 60% of its legal fees. Sounds extremely lopsided decision. I don't get it!

Firstly, Pakistan should not pay anything to BCCI as ICC does not have the power, they should have included this with the original verdict. Secondly, PCB should have Najam Sethi pay for all the legal cost incurred by PCB plus any legal cost they might have to reimburse to BCCI.

@Pasha, MOU is not an agreement. It is a plan, not a commitment by either party. In fact, if you read the verdict online, PCB sent BCCI the long form of agreement which was never executed. PCB wanted compensation from based BCCI based on a MOU rather than an agreement. Hence the arbitration verdict and its consequences of payment. Zaka Ashraf and Shahryar Khan of PCB were against this case and did not pursue it. Mr. Sethi felt differently and chose to proceed with the case. Rest is history.

PCB should refuse to pay. It’s not like world is taking up cricket in droves. There are still same number of test playing countries as 3 decades back. Penalising Pakistan Will neither be good for ICC nor cricket as a whole. Game on.

@Zak, there is no appeal, that’s what the Pakistan cricket board signed when taking up the case at the ICC. So did India, they both agreed to accept the outcome as the ICC is the final word.

The infamy of being made to pay all of the board's expenses plus 60% of BCCI's legal expenses definitely adds insult to injury for PCB. Actually, strictly from a legal stand point, now holding BCCI itself responsible for part of its legal expense is contradictory to ICC's own previous judgement of not holding BCCI responsible for any purported losses whatsoever . By this subsequent ruling, where it has held BCCI responsible for 40% of its own legal expenses, ICC is implicitly calling BCCI responsible for contributory negligence to the extent of 40%. Going by that line of thinking BCCI should not only be required to pay 40% of the boards expenses, but also 40% of PCB's legal expense as well as 40 % of the purported loss of $70 million claimed by Pakistan. This judgement is binding and non-appeable. Case closed.

With this, there is no likelihood of bilateral ties improving any time soon. PCB should concentrate at bringing PSL and International cricket back home. We can easily be in the top 4 cricketing countries (revenue wise)

PCB chose to read only the first part of the so called MoU that said India will play that many games with Pakistan. But they kept on refusing to acknowledge the second part that said “ subject to approval of both governments”. Right from day there was no case.

I support Najam Sethi in pursuing the case legally as it was evident from day one that we will loose the case due to hold on ICC by BCCI.But time does not remain same,one day the same ICC will review the decision and PCB will win the case with all claims and cost.The best thing is that our case was filed in time.We must look for future.

Then India filed a case to recover costs of the suit from Pakistan and the verdict was that PCB should pay 60% of India's legal cost and all of the administrative costs of ICC. How could the verdict of the second suit have been included in the verdict of the first suit?

@raj kumar, The decision of the court is final in this case as well. BCCI can't do jack about it. The reality is even the court in detailed verdict accepted that the PCB case is strong if we consider the 'wording' of the MOU. The reality is BCCI influence has played a role in this case otherwise Pakistan did have a strong case. Don't worry one day Justice will be served and BCCI and india will pay for the arrogance

Another self goal in a the long line of self goals by Pakistan. Its a long legacy, and looking at they way even the current Pakistani government leaders speak, there are more to come surely. And by antagonizing the BCCI, you have now vitiated the environment enough to prevent cricket as well. So, well done. Instead of understanding the genuine political issues, and using background channels to solve issues, this chest thumping by Pakistan has cost it dearly in virtually every sphere, but nobody's the wiser.
