LAHORE, Dec 16: The Lahore High Court on Tuesday disposed of a habeas corpus petition which was filed following the arrest of MNA Abid Sher, son of former Faisalabad mayor Chaudhry Sher Ali.
The court also adjourned on Wednesday the hearing of a writ petition under which the MNA had challenged his detention. The adjournment was sought by an additional advocate-general who wanted more time to submit a reply to questions why was the MNA put under detention and whether the government was justified in its action which followed a political speech.
The court disposed of the habeas corpus petition after the Punjab government produced a notification under which the PML-N legislator was detained on the charge of delivering an “objectionable” speech at a public meeting held in the Factory Area of Faisalabad about three weeks ago.
The habeas corpus petition was filed by detainee’s brother, Aamer Sher Ali, on the ground that whereabouts of his brother were not known. He wanted the Punjab government to produce the PML-N MNA in the court.
The PML-N legislator is being detained in the Multan district jail following his arrest under Section 3 of the Maintenance of Public Order Ordinance.
An additional advocate-general submitted the notification and informed the court that the MNA was accused of breaching peace as he had delivered an “objectionable” speech which could disrupt peace and social harmony.
The MNA who has already filed a constitutional petition against his detention terming it political victimization, intends to contest the government action.
