KARACHI, Dec 9: Justice Mushir Alam of High Court of Sindh on Tuesday suspended his earlier order for one week on an application by Karachi Port Trust against the release of MT Sea Angel.

The order came in an application moved by the KPT. Mansoor Shaikh, advocate, appearing for the KPT, submitted that the KPT was a claimant of port and other dues worth Rs144,003,255 from the owners of MT Sea Angel and if the vessel is allowed to sail out from Karachi port, defendant/ applicant would face a loss. Counsel for the applicant prayed to the court to suspend its order passed earlier on Dec 5, stating that the applicant is contemplating to prefer an appeal before the appellate forum.

The bench allowed the application, suspended its order with direction that in case applicant/defendant do not succeed in appeal, it shall pay for cost of each day to the plaintiff, Global Tradeways Ltd.

The impugned order was passed on a suit filed by plaintiff against TSavliris Russ (World Salvage and Towage Ltd) and KPT. The plaintiff maintained that the KPT, a defendant in the suit has detained the ship on the ground that plaintiff’s vessel has to pay port dues.

Agha Faquir Mohammed, appearing for the plaintiff, submitted that the KPT demanded port dues of Rs0.6 million against which Rs 1 million were deposited. He agreed to deposit Rs 1 million more towards settlement of port dues, etc., if any, accrued in future.

The SHC bench, allowing the suit, asked the plaintiff to submit Rs 1 million with the Nazir of the SHC for settlement of dues against the plaintiff while the KPT was ordered to issue “No dues certificate” to the plaintiff after deposition of money with the Nazir.
