KARACHI, Sept 22: A three-member bench of Federal Shariat Court, comprising Chief Justice Chuadhary Aijaz Yousuf, Justice Dr Fida Muhammad Khan and Justice Saeedur Rehman Farrukh, dismissed appeal of Amjad Pervez in dacoity case and converted Hudood sentence into 10 years rigorous imprisonment (RI).

The appellant had been punished with imputation of right hand from wrist and left foot from ankle under section 17(3) EOH 1979 by additional district and session judge on charge of committing dacoity on March 3, 2003.

According to prosecution, the appellant along with other co- accused committed robbery on Feb 16, 1998 at shops in Juna Market and looted Rs215,000 from shopkeepers. Police arrested him after shoot out while other co-accused managed to escape.

The court while dismissing the appeal converted Hudood sentence into Tazir under section 397 Pakistan Penal Code and sentenced appellant to 10 years RI.

Meanwhile, Chief Justice Chudhary Aijaz Yousuf of FSC admitted appeal of Muhammad Hussain Magsi for hearing against conviction awarded to him in attempt to murder and dacoity case and issued notice to state.

The additional district and session judge had sentenced the appellant and two others 17 years RI on charge of snatching motorcycle and injuring two persons.—PPI
