ISLAMABAD, June 5: A constitutional petition challenging NWFP Assembly’s competence of enacting passing the Shariat Bill will come for preliminary hearing on June 12.

An official of the Supreme Court said that the petition had been entertained and would be placed before the five-member bench on Thursday.

The petitioner, Dr Aslam Khaki, in his constitutional petition filed under Article 184 (3) of the Constitution, had challenged the NWFP Assembly’s rights to enact Shariat Bill, arguing that the subject of Islamization of laws was in the legislative competence of Parliament, and was enumerated in the federal legislative list.

He stated that Islamization of the laws was within the exclusive jurisdiction of Federal Shariat Court and there was no provision in the Constitution for the establishment of any parallel court or institution for the same purpose or any Provincial Shariat Court.
