ISLAMABAD: The chairman of Council of Islamic Ideology (CII), Maulana Muhammad Khan Sheerani, said that some clauses of the Khyber Pakhtunkhwa (KP) Domestic Violence Bill are in contradiction with Shariah and the country's Constitution.

Talking to media in the federal capital on Wednesday, Sherani said that CII is holding discussion over the bill and some clauses of it are under consideration for being in contradiction with the law of the land and also Shariah.

Sherani said that the CII's formation and authority is protected under the Constitution and if any assembly, whether provincial or national, moves to dissolve the council then that act will be considered against the Constitution of Pakistan.

"Tell me whether that assembly should be lauded or dissolved for acting against the Constitution," Sherani asked the media.

The KP government had sent the Domestic Violence Bill to CII to seek its advice, as it believes that the matter involves interpretation of Islamic injunctions.

On February 8, province's law Secretary Mohammad Arifeen told Dawn that Domestic Violence Bill had been pending for the last two months with CII where it was sent for interpretation.

According to Article 227 and 228 of the Constitution, the official said, no law which was repugnant to Islam could be enacted so that was why draft of Domestic Violence Bill was sent to CII to get its view on it.

However, under the Constitution, CII has to intimate within 15 days the government about how much time it would need to review the draft law.

Council of Islamic Ideology is a constitutional body that advises the legislature whether or not a certain law is repugnant to Islam, namely to the Holy Quran and Sunna.
