PESHAWAR: The Peshawar High Court was informed on Wednesday that 22 people had been kept at Lakki Marwat internment centre over involvement in terrorist activities and five over links with militants.

The internees involved in terrorism are placed in ‘black category’ and those linked to militants in ‘grey category’.

The information was shared by additional advocate general Mian Arshad Jan with a bench comprising Chief Justice Mazhar Alam Miankhel and Justice Mohammad Daud Khan during the hearing into a habeas corpus petition.

The petition was filed by Mohammad Ayub against the alleged illegal detention of his brother, Asghar Khan, and their worker, Abdur Rehman.

The AAG said the petitioner’s brother was traced in the Lakki Marwat internment centre.

“According to a report compiled by head of the internment centre Sabz Ali Khan, the petitioner’s brother has been placed in the ‘grey category’ of internees,” he said.

The petitioner alleged that his brother and worker were taken into custody by personnel of an intelligence agency and security forces on July 2, 2012, in Kohat and that they had been missing since then.

Few months ago, Asghar Khan was traced in Lakki Marwat internment centre, whereas the labourer continued to be missing.

The bench directed the AAG to try to trace the missing labourer.

The AAG said according to the report, the authorities had been taking care of internees in the best possible manner and that they had set up a 10-bedded hospital in the centre.

He said a medical officer and two male nurses had been deputed at the hospital.

The AAG said if the need arose, internees were sent to a local hospital for treatment.

According to the report, internees Akbar Ali, Mian Anwar, Abdullah, Mulazim Hussain, Mohammad Asif, Imdad Hussain, Asghar Shah, Qadir Shah, Yousaf shah, Rehmatzada, Idress, Nisar Ali, Ashiquddin, Rasool Niaz, Rehmatullah, Akhtar Ali, Daulat Khan, Zakirullah, Asghar Hussain, Mohammad Ayub, Abdullah and Noor Mohammad have been placed in the ‘black category,’

Similarly, internees Inamullah, Asghar Khan, Mohammad Hayat, Zameer Gul and Abdul Khaliq have been placed in the ‘grey category.’

These interns were picked up from different areas between 2009 and 2012.

The bench disposed of a habeas corpus petition filed by a woman, Mohajira Bibi, as her missing son, Ismail Khan, was freed by his captors.

The petitioner had alleged that her son was taken into custody by law enforcement agencies several months ago in the jurisdiction of the East Cantonment police station in Peshawar. She informed the bench that her son had returned home few days ago.

NOTICE ISSUED: A high court bench comprising Justice Asadullah Khan Chamkani and Justice Lal Jan Khattak on Wednesday issued notice to the National Accountability Bureau to explain viewpoint in a case about a convicted woman’s bail plea.

In the petition, a recently convicted woman, Nuzhat Begum, a former pension payment clerk of General Post Office, sought her release on bail on the ground that she is having an infant daughter with her in the prison.

The petitioner was convicted by an accountability court on March 31 in two references about embezzlement in payment of pensions. In both the references she was sentenced to six years imprisonment each with fine of Rs35.38 million.

She has challenged her conviction and also filed a petition seeking her release on bail till final decision on her appeal.

When the bench took up for hearing the petition it directed that the petitioner should be produced from prison along with the child so as to ascertain age of the infant. Later on, an assistant superintendent of Peshawar Central prison, Zahir Shah, produced the petitioner along with the infant girl.

The bench issued notice to NAB for today (Thursday) directing to explain its stance on her bail petition.
