HYDERABAD, Aug 1: Mr Justice Rehmat Hussain Jaffery of Sindh High Court Hyderabad circuit here on Wednesday issued notices to DPO of Umerkot, SHOs of Pithoro and Tando Adam police stations and three private respondents for August 8 on a constitutional petition filed by Ms Shamim Akhtar and her husband Mohammad Anwar.

They have moved the court through Ishrat Lohar advocate.

According to case of petitioner couple, she married Mohammad Anwar of her own free will before the Civil Judge and Judicial Magistrate of Mirpurkhas, saying that she was sui juris but Nazeer Ahmed and Abdul Hameed (both private respondents) got annoyed and started to harass them.

The couple due to harassment shifted to Umerkotand that two private respondents, after coming to know their whereabouts, approached Umerkot DPO and SHO of Pithoro police station started to harass them.

The petitioners said that the SHO visited their house and forced Mohammad Anwar to divorce his wife threatening of dire consequence in case of failure.

They said that DPO and SHO had no powers to interfere in their matrimonial life as they had married lawfully. But the police threatened them with dire consequences at the instance of private respondents.

The SHO of Tando Adam police station also came to petitioners’ house to harass them. They said their life had become miserable at the hands of respondents who were harassing them at the instance of private respondents.

They said on July 27, SHO Tando Adam police station trespassed into petitioners’ house and took away Nabi Bux Halepoto, the uncle of Mohammad Anwar, Khuda Bux, Abdul Ghani Halepoto, both cousins of her husband and kept them in wrongful confinement in Sanghar district.Therefore, they said, Anwar had serious apprehensions that detainees would be implicated in false cases by the police.

The petitioners said that they approached DPO Umerkot and SHO of Pithoro police station regarding illegal confinement of the above named persons without any entry with the concerned police.

They prayed the court to direct the DPO to direct the respondent to provide protection to them and SHO Tando Adam police station should produce detainees before the court. They requested the court to direct DPO and SHO not to harass the petitioners.

Meanwhile, the court issued notices to DPO Sanghar, SHO Shahdadpur police station and five private respondents for August 17 on a constitutional petition, filed by Ms Fehmida Khaskheli, seeking protection.
