SHC seeks report in riot victims’ case

HYDERABAD, March 31: A division bench of the Sindh High Court Hyderabad circuit has directed the Additional Advocate-General (AAG) Sindh to call a report from Senior Board of Revenue Member, who is also the Secretary Revenue Sindh, within two weeks regarding implementation on recommendations of rehabilitation committee for allocation of funds to 751 affected persons of ethnic riots of 1988-90.

The AAG was also directed to ensure that the matter was not allowed to shuttle between the government departments and, in case no positive response was received, the court may be compelled to summon the Chief Secretary of Sindh.

The order was passed on Thursday and its copy was made available on Saturday, after the court took notice that no funds were allocated in response to earlier order passed on February 22, 2006, requiring secretary Home Department to sanction requisite funds as recommended by Rehabilitation Committee Hyderabad on July 13,1998 in ensuing budget for next fiscal year.

The court had amended this order on October 18, 2006 and finance secretary was directed to appear and explain the position.

Along with statement on December 12,2006 the Finance Secretary intimated that action is taken for payment of compensation where a reference is received from administrative department after approval of competent authority i.e. chief minister Sindh, which has not yet been received in the instant case.

The AAG Sindh pointed out that the administrative department for the purpose of present controversy is the Senior Member BoR who is also the secretary to government of Sindh on revenue.

The court called a report from him within two weeks and adjourned the matter to a date in office.

Sajida Parveen and Hafeez Qureshi, two of 751 affected persons of ethnic riots of 1988-90 had filed contempt of court application after order on their constitutional petition on February 22 was not complied with.
