LHC verdict against UC proceedings

LAHORE, Nov 3: Justice Syed Shabbar Raza Razvi of the Lahore High Court on Friday suspended the proceedings and subsequent notification issued by UC No 273 of Faisalabad (urban) contending that nazim Syed Arif Husain Bokhari stood removed as a result of a no-confidence motion.

The nazim was removed after a recall motion, which, according to the union council record, was passed by a general meeting, held on Nov 1.

The nazim moved the LHC through advocate Azam Nazir Tarar, stating that all the proceedings and subsequent notification of his removal was unlawful.

His counsel submitted that the nazim went on leave on Sept 27 and the no-confidence motion was brought in his absence. He stated that section 85(5) of the Punjab Local Government Ordinance, 2001, provided for the opportunity of defence and personal explanation in case a recall motion was put in before a general house meeting for consideration.

He stated the motion was passed in the absence of the petitioner which was in contravention of the law.

FORKLIFT: The LHC registrar office on Friday returned to M D Tahir his petition through which he had challenged the forklifting of cars from the city crossings by police contractors in the absence of their owners.
