PESHAWAR, Sept 9: A medical officer was arrested in the Peshawar High Court on Wednesday after his bail was cancelled by a bench in a case of forgery.
The bench comprising Justice Malik Hamid Saeed and Justice Dost Mohammad Khan set aside the conviction of Dr Qamar Zaman, medical office rof the Shabqadar Civil Hospital, Charsadda, and sent his case back for re-trial.
The bench observed that it was now the discretion of the trial court whether to allow bail to the accused. The appellant was convicted by a special judge, anti-corruption, on Sept 29, 2001, and sentenced to one and a half years rigorous imprisonment with a fine of Rs15,000.
He filed an appeal against the judgment in the high court, which suspended his sentence and released him on bail till the disposal of his appeal. On Wednesday, the bench withdrew the order and directed police officials to take the appellant into custody.
His counsel requested for a bail but the bench observed that he should move the trial court. The appellant is charged with changing a medico-legal report in a murder case. An injured girl, Rahida, had stated before dying in the hospital that she had been attacked by her cousins Wasif Khan, Sheharyar and Asfandyar.
An FIR was registered at the local anti-corruption police station on April 17, 1998, against the doctor and an inquiry proved that he had changed the report. His counsel contended before the PHC that the trial court had acquitted him in four sections of the Pakistan Penal Code and convicted him under Section 161, which pertained to offering or accepting bribe. He said the ingredients were not present in the case.
CONVICTED: Ananti-terrorism court on Wednesday convicted two brothers of killing an accused in a courtroom and sentenced them to life imprisonment with a fine of Rs10,000.
The court presided over by Akhter Zareef Khan observed that the evidence on record connected Gul Rasool and Habib Rasool with the commission ofthe offence. The brothers had shot dead Mohammad Khan, who was facing trial for killing their father, in handcuffs in the court of additional district and sessions judge Tariq Sohail about five months back.
