PESHAWAR, June 30: A two-member bench of the Peshawar High Court on Wednesday summoned an investigation officer (IO) and an official of prosecution branch in a case, directing them to clarify how did they citethe Anti-Terrorism Act in an FIR.

The bench comprising Justice Tariq Pervez and Justice Dost Muhammad Khan directed that the IO of Daudzai police station and official of prosecution branch concerned should appear before the court on Thursday morning.

The bench issued the directives in a petition filed by a girl, Ms Rasheeda, against an order of an anti-terrorism court whereby the court had declined to hear the case on the ground that the act of hurling hand-grenades on the residence of the petitioner did not amount to an act of terrorism.

The petitioner stated that on March 24 the accused Jehanzeb and Waheedullah had hurled hand-grenades on their residence which resulted in severe injuries to her and her brother, aged seven.

She added that as a result of that attack her brother lost one of his eyes. The petitioner held that when an application was filed before the anti-terrorism court the presiding officer disposed of the petition, observing that the present case did not fall under the ATA, therefore they should move normal court for bail. The petitioner maintained that the attack on her residence amounted to terrorism and the court erred in declaring that it was not so.
