ISLAMABAD, Nov 3: The Supreme Court has held that the provisions of the Legal Framework Order will remain in abeyance till the time a notification is issued giving a date for the restoration of the Constitution.
The Supreme Court in its judgment on the petition of Mir Mohabat Khan Marri versus the election appellate tribunal, observed: “The provisions of LFO remain in abeyance till the issuance of requisite notification in the official gazette by the Chief Executive”.
The SC bench which passed the judgment comprised Justice Qazi Mohammad Farooq, Justice Rana Bhagwandas and Justice Abdul Hameed Dogar.
The court observed that with the enforcement of the proclamation of emergency enacted on Oct 14, 1999, the provisions of Article 62 and 63 of the Constitution were placed in abeyance whereas Article 4 of the LFO provided that the provisions of the Constitution, as amended by this Order, shall stand revived on such day as the CE may, by notification in the official gazette, appoint; and different days may be so appointed for different provisions.
