HYDERABAD, Jan 1: The Sindh High Court, Hyderabad Circuit Bench, has issued notices to the secretary, Agriculture and Livestock, the director general, Agriculture Extension, Market Committee, and the director, Agriculture Marketing, Hyderabad, on a constitutional petition.

The petition was jointly filed by M. Fayyaz Arain and M. Imran through Advocate Syed Masood Ali.

They said the respondent DG, Marketing, out of its own resources acquired land at Deh Gujjo within jurisdiction of Taluka city, district Hyderabad, in 1982-83 and in 1993-94 and established new fruit and vegetable market there after obtaining loan from the Asian Development Bank and investing major portion of funds on construction and development works of the market.

In 1993-94 a master lay out plan of the said project was prepared to allot plots to eligible traders of fruit and vegetable and the DG through elected Chairman, invited applications from traders for allotment of plots, in new fruit and vegetable market.

The petitioners applied for it on prescribed form and in accordance with terms and conditions, deposited requisite amount for purchase, thereafter provisional allotment orders were issued in favour of the petitioners.

They said the respondents without having jurisdiction had been illegally creating interference and hindrances in affairs of allotment of the market plots by not allowing the DG to accept cost of plots and issue regular allotment orders in favour of the petitioners.

He prayed the court to hold that all proceedings and referendum held on Oct 25 by the respondents and the allotment orders, possession letters, issued in pursuance of the said meetings, were illegal and allotment orders as per the previous plan be declared valid.
