PESHAWAR, Oct 20: An accountability court here on Saturday reserved judgment in a reference filed against a former supervisor of agriculture department, D. I. Khan, Enayatullah Gandapur.
The court, presided over by Miftauddin Khan, reserved the verdict after completion of arguments by both the parties and will pronounce it on Oct 30. Mr Gandapur has been facing trial for possessing assets disproportionate to his known sources of income.
Advocates Sanaullah Gandapur and Abdul Munim Khan appeared for the defence and argued that the defendant was falsely implicated in the instant case. The counsel pointed out conflict in statements of different prosecution witnesses, stating that the evidence on record went in favour of the defendant.
Initially, the National Accountability Bureau had arrested Enayatullah Gandapur and his brother Hidayatullah Gandapur, a former government servant. Both of them were jointly charged of possessing assets to the tune of Rs 60 million, which the NAB claimed was not in accordance with the known sources of income of the two accused. However, few months back the plea-bargain application of Hidayatullah Gandapur was accepted by the chairman of the NAB and the trial court and he was released from prison.
GUL SHER CASE: An accou-ntability court presided over by Syed Yahya Zahid Gillani has fixed Oct 27 for framing of charges against former tribal senator, Haji Gul Sher and three other accused in the Ring Road land acquisition scandal.
The four accused — Gul Sher, two patwaris Mohammad Nisar and Dilawar Khan and a former tehsildar, Mosam Khan — were provided copies of the reference.
In the same scandal five persons have already been sentenced in absentia to three years imprisonment for evading arrest. The said five persons are: former provincial minister Habibullah Kundi, three brothers of Gul Sher, Haji Juma Sher, Jamsher and Khatam Gul, and a former land acquisition collector, Ayub Shah.
Former NWFP chief minister Aftab Sherpao is also a co- accused in the present case but he has been absconding. On Saturday an Assistant Sub-Inspector of police station Tanghi, Ghareebullah, recorded his statement before the court. He stated that he took the warrant of arrest of Aftab Sherpao to his village in Sherpao, Charssada district, but the inmates there informed him that the whereabouts of Sherpao were not known.
The NAB has charged the accused of plundering the exchequer to the tune of Rs 283.514 million through a modus operandi based on withdrawal of a notification to allow owners to enter fake or fraudulent mutations at totally irrational prices resulting in payment of extra ordinary compensation.
