LAHORE, Oct 25: Lahore High Court Chief Justice Umar Ata Bandial denied on Thursday an instant relief to Jamatud Dawa against a ban imposed by the federal government on its activities, including collection of hides, on Eidul Azha.
The chief justice observed that the court did not issue any directive without hearing a point of view of the other side (government).
On behalf of JuD chief Hafiz Muhammad Saeed, Advocate A.K Dogar tried hard to persuade the chief justice that the ban was imposed in the light of a resolution passed by the United Nations Security Council while the organisation of his client was not proscribed under any law of the land.
The counsel said the impugned ban was a clear violation of the petitioner’s fundamental rights enshrined in the Constitution.
The chief justice, however, remarked that the federal government had imposed the ban to fulfill its international obligation being a member of the United Nations. “How can the court suspend international obligation of the country,” the chief justice questioned the counsel.
The chief justice advised the counsel not to use a court of law to get the ban abolished and to establish that the JuD was a public welfare organisation, adding let the people decide whether the JuD was a charitable organisation.
Advocate Dogar pleaded that the ban was imposed days before the Eid which clearly showed the mala fide intention of the government.
He said Thursday was the last working day before the Eidul Azha and there would be no use if the court issued any stay order after the Eid.
The chief justice, however, refused to issue any stay order without seeking a reply from the government.
He rejected the stay application and issued a notice to the federal government for next week.
