NAWABSHAH, Oct 22: A court on Monday directed the Nawabshah police to register a second FIR on the complaint of Jeay Sindh Qaumi Mahaz (JSQM) pertaining to the death of its former chairman Bashir Khan Qureshi.

The court was seized with the an application filed by Maqsood Qureshi, the brother of the deceased, who alleged that his brother had been murdered on April 6 but the police station concerned was not entertaining their request of registering a murder case.

Maqsood Qureshi, along with Sannan Qureshi, the deceased’s son, filed the application in the court of Additional Sessions Judge-III Inam Ali Kalhoro under Section 22-A, Sub-section 6 (1) Cr.PC on Oct 15 praying to the court to direct the SHO of the Sakrand police station to register the FIR against Federal Interior Minister Rehman Malik, ISI Director-General Maj General Zaheer-ul-Islam and former Sindh Rangers director-general Aijaz Ahmed Chaudhry.

The applicant’s counsel, Sarfaraz Khan Jatoi, on Monday informed the court that Bashir Khan Qureshi was declared dead by doctors on April after which a post-mortem examination was performed and the preliminary report suggested that phosphorus was found in his body.

He further stated that his client approached the Sakrand police on Sept 27 to lodge a murder FIR but they refused to entertain his complaint. Later, the counsel said, the police on Oct 3 registered an FIR on their own which did not reflect the facts about Mr Qureshi’s death.

The Sakrand SHO told the court that the FIR of the case contained proper facts and, therefore, the application was not maintainable.

The judge observed that it was not within the domain of a police officer to act arbitrarily or whimsically.

He ordered the SHO to act in accordance with the law, entertain the complaint of the complainant and register FIR as required under Section 154 of the CrPC.—BoC
