KARACHI, Aug 24: A policeman managed to escape from the premises of the city courts on Friday following the dismissal of his pre-arrest bail application in a fraud case.
Assistant Sub-Inspector Yousuf Raza along with some other policemen has been booked for allegedly helping a man get the possession of two abandoned vehicles on the basis of forged documents.
The policeman, through his lawyer, moved a pre-arrest bail application before an anti-corruption court.
Earlier, the court granted him an interim bail till Aug 24 and asked him to appear in court for the confirmation or dismissal of the bail.
Judge in charge of the special provincial anti-corruption court in Karachi Hasan Feroz dismissed the plea after hearing arguments from both sides.
As soon as the order was pronounced, the policeman made an easy escape in the presence of the investigation officer.
According to the prosecution, the Darakhshan police seized two abandoned vehicles a few months ago under Section 550 (powers to police to seize property suspected to be stolen) of the criminal procedure code.
A man, Ayaz, with the help of some policemen prepared forged documents and moved the court of a judicial magistrate to get the custody of the two vehicles.
The judicial magistrate called a report from the police station concerned and the ASI through the then SHO submitted that the police had no objection if the court granted the custody of the vehicles, it added.
The court passed an order directing the SHO to hand over the possession of the vehicles to the real owner after verification.
The police handed over one vehicle to Ayaz. However, they came to know about some forgery and they lodged a case (FIR 199/12) against Ayaz at the Darakhshan police station on a charge of fraud and arrested him.
The matter was reported to the anti-corruption establishment and they registered a fresh case (FIR 12/12) under Sections 420 (cheating and dishonestly inducing of property), 468 (forgery for purpose of cheating), 471 (using as genuine a forged document), 409 (criminal breach of trust by public servant or buy banker merchant or agent) and 34 (common intention) of the Pakistan Penal Code read with Section 5(2) of the Prevention of Corruption Act, 1947.
The court also dismissed the bail application of the suspect on Friday.
