RAWALPINDI, Sept 3: Chief Justice (CJ) Islamabad High Court (IHC) Sardar Mohammad Aslam on Wednesday disposed of the writ petition of Sardar Zaheer Ahmad Khan challenging the qualification of Asif Ali Zardari as a presidential candidate.

The IHC CJ observed that since ballot papers for the presidential elections had been published and no one out of the three major presidential candidates had raised any objection against each other, and with three days had been left to the elections, the court might not find it appropriate at this stage to issue a stay order.

The petitioner had stated that the nomination of Asif Ali Zardari as presidential candidate was against the law, constitution of Islamic Republic of Pakistan and Islam. He had raised two main objections on Mr Zardari first he is “Ghair Ameen” (untrustworthy) and secondly he is a patient of psychosis, a mental disease.

According to the petitioner Asif Ali Zardari is a self proclaimed patient of psychosis, a severe mental disorder in which the patient departs from the normal pattern of thinking, feeling and acting. The petitioner further said that neither article 62 and 63 of the 1973 constitution of Islamic Republic of Pakistan nor any other law had said or could say that a Ghair Ameen, patient of psychosis by his own plea and self confessed untruthful person could be foisted as President of Islamic Republic of Pakistan.

Earlier, Sardar Zaheer Ahmad Khan had filed his petition before Chief Election Commissioner against the nomination of Asif Ali Zardari as President that was rejected.

He then moved IHC against the decision of Chief Election Commissioner.

He had prayed to the court to direct the Election Commission to reject nomination papers of Asif Ali Zardari.

Chief Justice Sardar Mohammad Aslam separately issued notices to SSP Islamabad and SHO Abpara police station to submit reply in the alleged abduction case of Khalid Khawja Chairman Defence of Human Rights.

Khalid Khawja in his petition before the IHC had alleged that the police and the security officials acting at the will of their superiors including former President General (R) Pervez Musharraf, former Prime Minister Shaukat Aziz and former Interior Minister Aftab Ahmad Khan Sherpao abducted him, kept him behind the bars and registered false cases against him.

The petitioner said he was forcibly abducted from outside his house on January 26, 2007. The persons responsible for abduction of the applicant did not disclose their identity and were dressed in civilian clothes. The petitioner was forced into a car, blindfolded and after a drive of approximately 30 minutes he was detained in a building till 11:30 pm. The petitioner was then taken to Aabpara Police Station and Sub-Inspector (SI) Ghulam Mustafa registered an entirely false and fabricated criminal case against the applicant vide FIR No.36 dated 26.01.2007 U/S 295-A/188 PPC.

According to the SI the petitioner was apprehended at 12:30 PM on 26.01.2007 while allegedly distributing pamphlets in the vicinity of Lal Masjid.

The petitioner through his petition before the court has stated that all these illegal and unlawful acts against him were done on the behest of former president Pervez Musharraf, former prime minister Shaukat Aziz, former federal minister for interior Aftab Sherpao and many others working on their instructions. He has prayed to the court to issue directions to the authorities concerned to register FIRs against these persons mentioned above.
