KARACHI, Aug 27: A judicial magistrate, on Wednesday issued 19th show-cause notice to the investigation officer asking him to submit the charge-sheet of a murder case registered against three police constables some five months ago.
Earlier, the court had issued 18 show-cause notices to the investigation officer directly as well as through his superiors since April 4. However, the IO has failed to comply with the court’s order.
According to Section 173 of CrPC, an investigation officer is bound to submit the charge-sheet to the court within 14 days after the arrest of accused. The police constables Mohammad Imran, Arif Hussain and Salman Farsi had allegedly opened fire upon Zubair Khan and Mohammad Saqib on March 21 near Sakhi Hassan, North Nazimabad. Both the youngsters were rushed to Abbasi Shaheed Hospital, but Zubair succumbed to his injuries while Saqib sustained serious injuries.
A case (FIR No 164/08) was registered under Sections 302, 324/34 of Pakistan Penal Code at complaint Taimuria police station against the policemen.
Arrest warrants for complainant, others
An additional district & sessions judge, Central issued on Wednesday non-bailable arrest warrants for a complainant and bailable warrants for the four witnesses in a case pertaining to a bus accident in which two college girls were killed and many other injured.
The judge directed the police high-ups to arrest the complainant and witnesses, and produce them before the court on Sept 22.
Earlier, the court had issued many notices to the complainant, sub-inspector Zafar Iqbal and witnesses ASI Irfan of Sharifabad police station, Madeeha, Shahida and Saher Afshan, the students injured in the accident and directed them to depose their statements. However, they did not turn up.
According to the prosecution, Nida Afzaal and Ravia Beenish, the two intermediate students of APWA collage of Karimabad were killed and many other injured on February 19, 2002 when the driver of route 5-C bus (JA 5983) while racing with another bus lost control.
The driver, Mohammad Munawwar and bus owner M Ibrahim were arrested after the incident. Sharifabad police station registered a case (FIR No.054/02) against them under Section 320, 322 and 337 of Pakistan Penal Code. They were later released on bail. Meanwhile, an additional district and sessions judge (Malir) re-issued on Wednesday notices to the witnesses in a murder case registered against Mohajir Qaumi Movement chief Afaq Ahmed and others.
The judge Mohammad Siddiq Abbasi, who is conducting the trial inside the Central Prison, had issued notices to the witnesses directing them to record their statements, however, they did not turn up.
On July 30, 2002, Zubair Ali, son of Mashooq Ali, along with his mother Rafiqun Nisa was returning home in Nazimabad in a cab, when it reached Ammar Yasir Society near Lilly Town, three to four unknown persons allegedly opened fire at their taxi injuring his mother and the taxi driver, Kafiluddin.
The complainant took his mother to Al-Mustafa Trust, while Kafiluddin was rushed to the Jinnah Postgraduate Medical Center (JPMC) where he succumbed to his injuries.
The police had registered a case (FIR No144/02) under Sections 302, 324, 109/34 of the Pakistan Penal Code at Malir City police station against Afaq Ahmed, Amir Khan and others stating the firing was took place on their behest.
The hearing was adjourned for Sept 10.
