KARACHI, July 15: The civil judge and judicial magistrate, Central, Khushi Mohammad, on Tuesday indicted two suspects on the charges of kidnapping a newborn from a hospital in New Karachi.

The two suspects, Mehwish and Sadiqa, midwife at the hospital, pleaded not guilty and opted to contest the case. The court put off the hearing and summoned all the prosecution witnesses to record their statements on July 23.

According to the prosecution, Qamar Jahan had given birth to a baby girl on June 8. However, the girl was found missing the next morning. On a complaint of the newborn’s father, Mohammed Shahid, police arrested the midwife, Sadiqa. During preliminary interrogation, the suspect confessed to having kidnapped the child and disclosed that she had handed over the baby to a woman, Mehwish, for Rs40,000. The police later arrested Mehwish.

A case (FIR 133/2008) was registered against the suspects at New Karachi police station on Mohammad Shahid’s complaint. Both the suspects got bail from the trial court.

Seven-year term

The additional district and sessions judge, South, Ibrar Hussain Memon, found two accused guilty of injuring a person during a robbery attempt and awarded each a seven-year imprisonment.

The court, in its verdict, stated that the prosecution had produced sufficient evidence and successfully proved its case against the accused, Abdul Hameed and Nazir Ahmed, who were charged for injuring one Khalid Mehmood while committing a robbery.

Imposing a fine of Rs25,000 payable by each accused to the complainant as compensation, the court stated that the accused would undergo an additional three-month term in case of non-payment of the fine.

According to the prosecution, Abdul Hameed and Nazir Ahmed had allegedly opened fire at Khalid Mehmood as he resisted the robbery attempt. A case (FIR No 295/2004) was registered under Sections 393 and 394 of the Pakistan Penal Code at Darakhshan police station.

Warrants for cops

A civil judge and judicial magistrate, South, on Tuesday issued non-bailable warrants for the arrest of ASI Zulfiqar Khokhar, head-constable Zahid Hussain and constable Mohammad Khan for not appearing in the court to testify in a case registered under Section 13-D of the Arms Ordinance.

Earlier, the court had served many reminders and notices to the prosecution witnesses. However, they did not turn up.

The case (FIR87/08) was registered against Mohammad Sarwar Anis at Zaman Town police station. The court fixed August 13 as the next date of hearing.

Qasim Toori case

The anti-terrorism court-II on Tuesday adjourned till July 24 the hearing of a case against Qasim Toori pertaining to an attack on the convoy of the then crops commander Karachi in 2004 since the original file of the case was in the High Court of Sindh.

According to the prosecution Qasim Toori, along with his associates, had allegedly attacked the convoy of the then corps commander of Karachi, Lt-Gen Ahsan Saleem Hayat, near the Clifton Bridge on June 10, 2004. The corps commander remained safe during the ambush, however, around 11 people were killed and 12 others were injured in the incident. A case (FIR No 165/04) was registered against the accused at Clifton police station under Sections 302, 324, 404/34 of the Pakistan Penal Code and Section 3/4/5 of the Explosive Act read with Section 7 of the Anti-terrorism Act. The 10 other accused of the case had already been awarded death sentences by an anti-terrorism court and the appeals against the decision were pending in the high court.

Toori and his other associates were arrested on Jan 29, 2008 in a massive gun-battle with the police and other law-enforcing agencies in the Shah Latif area of Bin Qasim Town. Shahab, Bilal, Hamad and Tayyab alias Saad were declared absconders in the case.
