NAB officials face contempt proceedings

QUETTA, Aug 3: Justice Javed Iqbal of the Supreme Court on Friday ordered contempt of court proceedings against the director general of National Accountability Bureau, Balochistan, and its two investigation officers for wilfully disobeying court orders.

Expressing dissatisfaction over the explanation submitted by the NAB officials, the single-judge bench directed that the entire record of the case should be sent to the main registry of the Supreme Court in Islamabad for further action.

NAB Prosecutor General Dr. Danishwar Malik, on behalf of the director general, filed the explanation sought by the court on a complaint of Abdul Majid that his son Nadeem Majid was not released by the NAB authorities despite having received court orders.

Investigation officers Noor Muhammad and Abdul Salam, who were present in the court, also filed their explanations.

The learned judge said that the explanation filed on behalf of the NAB director general was not satisfactory in view of the history of the case and wilful disobedience and non-compliance of court orders.

The order said the contempt of court proceedings would be initiated against him and the NAB Balochistan deputy prosecutor general who indulged in unnecessary correspondence with the Supreme Court.

The court said the investigation officers had crossed their limits and jurisdiction by raiding the office and residence of the complainant without completing necessary and mandatory legal formalities.

The order said that the explanation submitted by the investigation officers was also not satisfactory and, therefore, contempt of court proceedings would be initiated against them.

The court ordered the NAB director general to take disciplinary action against the investigation officers for exceeding their lawful jurisdiction and powers. The learned judge remarked: “The NAB is not above the law.”
