HYDERABAD, April 5: The Hyderabad circuit bench of the Sindh High Court has ordered demolition of an unauthorised structure raised above the basement of a residential-cum-commercial centre on the Station Road.

The division bench comprising Justice Mushir Alam and Justice Faisal Arab passed the order on a public interest petition filed by Ikramuddin, general secretary of Hyderabad Electronics Dealers Association, who had questioned legality of six plazas in the vicinity of Rahat Cinema.

The court had ordered Additional Advocate General (AAG) Masood A. Noorani in January to carry out detailed inspection of the buildings and gave its verdict after perusal of the AAG’s report.

Referring to the report the court said that it showed that Ghausia Electronics Centre's construction had been made in violation of approved plan and also proved inefficiency and incompetence of HDA officials who approved the plan against the authority’s own by-laws.

“In the first step, we would direct that all the unauthorised construction raised over the basement of Ghausia Electronics building might be removed and parking space be resorted,” the order read.

The court asked the “HDA to file a list of officers concerned who supervised and regulated the construction of subject building and show cause as to why the costs for restoration of parking space might not be recovered from the HDA and such delinquent officers and compensation might not be awarded to affected persons who might be removed as a result of such exercise,” the court ruled.”

The bench said that the structure be demolished after serving notices on all the occupants giving them at least two weeks time.
