PESHAWAR: Man awarded 16-month RI for abusing minor boy

PESHAWAR, Feb 24: A man was sentenced here on Saturday to 16-month rigorous imprisonment for sexually abusing a child.

Additional district and sessions judge Jamaluddin Khan ruled that the evidence on record had proved that the accused, Ijaz Khan, had committed the crime.

Chamkani police officials, who had arrested Ijaz Khan on September 18, 2005, said that during a routine petrol they heard a child screaming. They said when they entered a nearby field, they saw the accused sexually abusing a boy ageing seven or eight years.

According to the police, the child was bleeding and was in great pain. He was sent to Forensic Science Department of the Khyber Medical College for medical examination, whereby it was confirmed that the child was sexually abused.

An FIR was registered against the accused, a resident of Qazi village here, under section 377 of the Pakistan Penal Code and section 12 of the Offence of Zina (Enforcement of Hudood) Ordinance, 1979. Public prosecutor Jehanzeb Khan argued that the accused was caught red-handed by the police. He contended that the medical examination report also supported the prosecution version.

Application dismissed: Additional district and sessions judge Mohammed Iqbal Khan dismissed here on Saturday an application filed by a woman seeking custody of her minor son.

The decision came after the six-year-old boy said that he wanted to live with his father, Riaz Khan, in reply to a court inquiry.

The woman, Ms Gulnaz, had filed a habeas corpus petition under section 491 of the Criminal Procedure Code.

She said she was married to Riaz and had a son. Difference emerged between them after which they separated, she said.

She said since her husband had now contracted a second marriage, her son should be handed over to her as a stepmother would not look after him properly.

During the previous hearing, the court had directed the police to produce Riaz and his son. Riaz told the court that the child was happy with him and loved him more than his mother.
