KARACHI, Oct 12: An additional district and sessions court issued bailable warrants for the arrest of a retired major, who had allegedly sent a fake letter of Central Officers Record Office (CORO), GHQ, in the Colonel Zargham case. The judge directed the police to arrest Major (retd) Noor Kareem and produce him before the court on Nov 3.
Col (retd) Mohammed Zargham Mirza had lodged a private complaint against Major (retd) Noor Kareem after his direct complaint for registration of a criminal case against 20 respondents, including former chief of the Citizen-Police Liaison Committee Jamil Yousuf and Senior Superintendent of police A D Khawaja, was dismissed by a judicial magistrate on the basis of the bogus letter.
According to the army officer, he was implicated in a case by the respondents, who hatched a conspiracy to defame Pakistan Army. Those made respondents in the complaint included Zaeem Iqbal, ASP, Lubna Tiwana, the then SHO of Women Police Station, Inspector Abdul Hakim Bangash, Azhar Ellahi and Sharf Memon.
Later, the judicial magistrate dismissed the complaint after recording the statements of over a dozen witnesses. The main ground for dismissing the major's complaint was a fake letter allegedly sent by Major Noor Karim to the court through post. The letter stated that Major Zargham was found guilty in the court of inquiry commission.
Afterwards, the army officer filed another complaint in the court seeking action against Major Noor Karim. The court recorded the statement of Major Niaz of Central Officers Record Office (CORO), who deposed that the said letter was bogus.
He further stated that Major Zargham was retired as Lt-Colonel after completing his "long and meritorious service in the army".
According to the Zargham Mirza, he was implicated in the case by the respondents to defame the army.
In his complaint, lodged with the permission of 5-Corps, Major Mirza stated that on Jan 9, 2000, a woman, Saba Ibad, knocked at his door to make a phone call. She left his home with her cousin, Hasan Abidi, who reached there after 20 minutes.
The major stated that the woman, with her cousin, again visited his house after two days, but he refused to help them any more and informed the CPLC.
He submitted that Saba, being followed by the CPLC men, reached his residence on Jan 13. He said the woman was moved to her parents with Mrs Shaheena Mehmood of the CPLC.
On the same day, Abaduddin, the father of the woman, lodged an FIR under section 11 of Hudood Ordinance with the Baloch Colony police.
However, later the matter was taken up by the military court where the father of the woman deposed that he was forced to get the FIR lodged.
Five senior army officers, three of them serving, were among those who were summoned as witnesses by the magistrate on an application of the complainant. They also recorded their statements.
