KARACHI, Feb 3: The Sindh High Court issued non-bailable warrants for the arrest of a petitioner builder and directed the Karachi Building Control Authority to complete the demolition of a violative building on Tariq Road.
Petitioners Mohammad Asif and Zeeshan Asif moved the court when the KBCA commenced demolition and obtained a stay order. They challenged the demolition and the notice earlier issued by the KBCA in this behalf, saying that they had submitted a regularization plan, which was wrongfully rejected by the authority.
The KBCA informed the bench through Advocate Shahid Jamil Khan that that the building raised on plot 172-E, Block 2, Main Tariq Road, grossly violated the approved plan and building rules and regulations. Shops were constructed in the basement meant for car parking and the corridors were also covered. There were other minor violations.
The structure could not be regularized even under the ordinance promulgated in 2001 to allow one-time exemption to violative buildings.
The petitioners failed to appear despite notices after obtaining a stay order. The court issued bailable warrants and asked them to execute personal bonds in the sum of Rs25,000 each before its nazir. The petitioner again failed to appear as the matter came up before a division bench, comprising Justices Syed Zawwar Hussain Jaffery and Maqbool Baqar. The bench issued non-bailable warrants and adjourned the hearing to March 7.
