PESHAWAR: Contempt notice served

Published September 23, 2004

PESHAWAR, Sept 22: A two-member bench of the Peshawar High Court on Wednesday issued show-cause notice to the Peshawar district revenue officer (DRO) in a contempt of court case.

The PHC bench, comprising Chief Justice Nasirul Mulk and Justice Shahjehan Khan Yousafzai, directed the DRO to show cause why proceedings should not be started against him under the Contempt of Court law.

The DRO was charged by a petitioner, Waqif Khan, of violating the court's order issued a few days ago. The court had issued a stay order in favour of the petitioner, who was a patwari and had been transferred repeatedly in a short period of time.

Last time the petitioner was transferred to Bana Mari area from where he was subsequently transferred to the tehsil office. He had filed a writ petition against that order and prayed the court to declare it illegal.

He had also requested the court that till the final disposal of the writ petition he might be allowed to continue at Bana Mari. The High Court bench had granted an interim relief to him a few days ago and on Tuesday last the court had confirmed that stay order.

Nusrat Yasmeen appeared for the petitioner and contended before the bench that the DRO had violated the order of the court and was not allowing the petitioner to work at Bana Mari.
