LAHORE: Plea against Usman put off until 9th

LAHORE, July 6: The Lahore High Court adjourned until July 9 the hearing of the writ petition, which challenges the action of the Data Ganj Bakhsh Town Naib Nazim of returning a non-trust motion against Nazim Khwaja Ahmad Hassaan.

Advocate Muhammad Ahsan Bhoon, the counsel of petitioner Abdus Samad Ghani, on Tuesday concluded his argument primarily based on the contention that the Naib Nazim had misinterpreted the Punjab Local Government Ordinance.

The Naib Nazim's counsel, Advocate Omar Bandiyal, had just started his arguments when the court adjourned the hearing. Mr Ghani, a union council Naib Nazim and ex-officio member of the town council, was the mover of the recall motion against Khawaja Hassaan.

Naib Nazim Mian Usman returned the motion to the mover with the observation that it was the second such motion in a year, which was not allowed by Section 63(8) of the Punjab Local Government Ordinance.

Mr Ghani challenged the contention of Mian Usman on the plea that he had misinterpreted the law, which prevented a second recall motion in a year only if the first failed.

Advocate Bhoon contended that the legal condition was that a second recall motion could not be presented within a year if the first such motion was defeated or not voted upon.
