HYDERABAD, April 23: A division bench of the Sindh High Court, Hyderabad circuit, on Friday issued notices to the DCO and the EDO revenue of Badin district , the Sindh additional advocate-general and the PRC appellate committee on a constitutional petition filed by a student, challenging cancellation of his permanent residence certificate.

The officials have been directed to appear before the court on May 6. He said he was selected in the Liaquat University of Medical and Health Sciences in November 2003.

He said he appeared before the EDO revenue after some people filed appeal against issuance of domicile and PRC to him and that he also appeared before the DCO but he was not heard in person and the decision concerning cancellation of domicile was announced by the respondent DCO.

The petitioner said that the DCO sent a notice to the LUMHS mentioning therein that the petitioner's domicile was under objection, therefore, fee should not be accepted from him.

He said that his father worked in the health department and was issued domicile in 1983. The petitioner said that the DCO and the EDO revenue missed the fact that in the CNIC, permanent address of his father remained Badin district.

He said that the respondent DCO and EDO did not note that no objection was raised in the entry of his father's name in voters list. He said that the LUMHS cancelled his admission without issuing a timely notice and providing an opportunity of hearing.

He said the appeal was filed by him before the appellate committee under the Sindh PRC Rules 1971 but it was dismissed on Feb 12. He prayed the court to set aside the order of the respondent appellate committee and declare that the petitioner had the right to continue his studies in the LUMHS.
