PESHAWAR: Bail plea of juvenile suspect rejected

PESHAWAR, Jan 24: The Peshawar High Court dismissed on Friday bail petition of a juvenile offender charged with a murder case. A single bench, comprising Justice Malik Hamid Saeed , observed that being a juvenile did not mean that he should be allowed to commit heinous offences. The court observed that he did not deserve any leniency merely on the ground of being a juvenile offender.

The accused-petitioner, Dunyadar son of Jan Mohammad, is charged along with his two brothers with killing a boy named Nasrullah and injuring his father Syed Karam. The occurrence had taken place in the jurisdiction of Khwazakhela police station (Swat) on April 19, 2003.

The petitioner is said to be 15 years of age. The court observed that being a minor the petitioner was acting in such a manner how he would act after becoming 18.

The police had also charged the boy of opening fire at the police party when they went to arrest him. His bail petition was earlier dismissed by a Qazi court in Swat.

Advocate Jan Mohammad appeared for the petitioner, and argued that he was a minor and was entitled to bail under the law.

He contended that his involvement in the commission of the offence had yet to be proved and merely by naming him in the FIR he could not be held responsible.
