PESHAWAR, Dec 9: A two-member bench of the Peshawar High Court on Tuesday ordered deportation of an Afghan political organization’s leader, Shan Bacha Shinwari.

The bench, comprising Chief Justice Mian Shakirullah Jan and Justice Shehzad Akber Khan, disposed of a writ petition challenging the detention of Mr Shinwari, chief of the Afghanistan National Defender Islamic Front.

The petition was filed by Haroon Bacha, a nephew of Mr Shinwari.

Appearing for the petitioner, Advocate Wali Khan Afridi argued that Mr Shinwari was not involved in any crime and his detention was illegal.

He said Mr Shinwari was picked up from settled area and he could not be kept under the Frontier Crimes Regulations by the tribal administration.

Additional Advocate-General Sardar Shoukat Hayat contended that the detainee was involved in activities detrimental to Pakistan.

He informed that Mr Shinwari was arrested by an intelligence agency and after investigation he was declared “Black”, a term meaning ‘not innocent’.

Mr Hayat said that later Mr Shinwari was handed over to the tribal administration.

He informed that one of his friends, Abdur Rehman, was earlier arrested on the same charges and had already been deported.

The bench inquired why Mr Shinwari was shifted to the custody of tribal administration when he was arrested in settled area.

Mr Hayat replied that after the agency had interrogated the detainee he was no longer required by them.
